57.998             Physicians Victims of Hacking

The Medical Society of the State of New York advocate for state and federal laws that protect patients’ and physicians’ ability to submit and be paid for claims when criminal activities result in temporary or permanent damage to electronic systems, limitations on physicians, and ability to conduct electronic transactions and in the event a system failure occurs. If claims cannot be executed, once the system is operational, physicians and other healthcare providers may resubmit claims, appeals, and other required paperwork for a period of time that is at least twice the length of time as the period of system failure. MSSNY should advocate for the immediate development of a multidisciplinary taskforce including representation of MSSNY, Health Insurers, DFS, NY State Police Computer Crime Unit, the FBI, and other pertinent stakeholders to prevent future healthcare cyberattacks in NY and to increase the apprehension of Cybercriminals who prey on patients and Healthcare entities and recommend appropriate penalties for their crimes. MSSNY through its representation in the AMA, will encourage the AMA to advocate for similar action at the federal level. increased Federal penalties for and prevention efforts against Healthcare Criminals who commit interstate and international cybercrimes.
